Activision Suing Double Fine
If you all remember right, last year during the Activision-Blizzard merger, Activision dropped Brutal Legend from its catalog along with a handful of other games, where it looked like it was going to die until EA chose to publish it.
Now Activision is claiming they still own Brutal Legend, and are trying to sue Double Fine and delay the game's release.
Seriously there guys? I think EA themselves put it best, saying it's like "a husband abandoning his family and then suing after his wife meets a better looking guy."

Re: Activision Suing Double Fine
Activision is just looking to make some easy cash out of this one. I foresee a settlement in the near future.

Re: Activision Suing Double Fine
From Wikipedia: Quote: In February 2009, Activision Blizzard had asserted that the Electronic Arts deal is invalid, believing that they were still in negotiations with Double Fine to publish the game. It is believed that Activision is seeking monetary compensation in a similar manner as it received from Atari for Ghostbusters: The Video Game and The Chronicles of Riddick: Assault on Dark Athena, games that were dropped when Activision Blizzard re-evaluated their assets. On June 4, 2009, Activision filed suit to prevent publishing of the game, claiming that they have invested $15 million in the title and still has a valid contract to release the game. Activision's suit also contends that Double Fine had missed a deadline for the game last year, requesting more time and an additional $7 million in development fees. Activision's considers both the loss of the money they spent on the game as well as potential sales and Brutal Legend-related merchandise as part of the harm done in the lawsuit.
After Activision dropped Brutal Legend, I was angry (and thought the game would never see the light of day. Now they do this. It's quite clear (based on their previous suites) that this is all about the Money. They also should learn not to poke the bear. EA is not Atari, and is not likely to give them a dime. (And has a much bigger legal team to back them.)

EA Vs Blizzard, very interesting to say the least. Imho EA would stomp Blizzard into the dirt without breaking a sweat.

Its EA vs Activision - Blizzard has nothing to do with it. They may be part of the same company but there not like the low lifes that work at Activision.

Re: Activision Suing Double Fine
EA is really pimping Double Fine/Brutal Legend. I saw part of their E3 conference yesterday on the brutal legend website. It's really interesting to hear their MC speak and say things like: "We intend to dominate [I may have used the wrong word here, but it was that style of word, dominate, rule, be on top, etc.) this business like we did a few years ago. We intend to do that by hiring the best talent and releasing the best games."
Which really means a) EA wants to be #1 again (who doesn't) and b) I think EA has realized that releasing "sports game [year]" isn't going to help them anymore. That ship has sailed. and c) Kicking around your developers is not good business. The New EA is actually quite nice, picking up IP's (like Brutal Legend and Mass effect) and making good games. Sure they're still releasing "sports game [year]" but they're extending. (And working as publisher for other companies, like Valve, DF, Bioware, etc.)

Re: Activision Suing Double Fine
And now Double Fine is fighting back: http://www.joystiq.com/2009/07/22/double-fine-countersues-says-activision-will-not-kill-brutal/The best part of this, though, is that Activision might have been trying to change it into a Guitar Hero sequel. Oh you wacky guys. I wonder how long until we get Call of Guitar: Modern Rocking.

Re: Activision Suing Double Fine
Apparently when Schaffer pitched Brutal Legend to Activision they didn't like the metal theme and they recommended Double Fine go in a country or hip hop direction.

Looks like they settled, and while the terms aren't public, it sounds like Double Fine wins

http://www.el33tonline.com/past/2009/8/ ... ttle_over/Quote: Super-publisher Activision Blizzard and tiny development studio Double Fine Productions have finally settled the dispute over the latter’s heavy metal inspired action adventure game, Brütal Legend.
This allows the Brütal Legend’s new publisher, EA, to continue with its marketing schedule ahead of the game’s launch in mid-October this year, and release without fear of retribution from Activision Blizzard.
So I mean, the game is going to be promoted and released, so I'm happy. And furthermore: http://www.joystiq.com/2009/08/07/activ ... utal-lege/Quote: Overall, it looks like Activision was the "loser" in this agreement, though, of course, the whole point of settling was to avoid having a loser. First off, the source claims that the game will be released as planned in October. Second, the LA Times says, "it appears very likely that Activision received little to no compensation from Double Fine and agreed to a settlement to avoid losing its case in open court."
So it really seems like Activision figured they were going to lose the case, and decided to cut their losses. So more reason to be happy, since it doesn't sound like DF had to pay or give anything to Activision over it.
